今日【平評理】 平秀琳頻道

因為最近王偉忠訪問平秀琳,又回憶起這位聰穎的大姐。偉忠哥與平秀琳,兩人對談值得一看,很過癮。

喜歡這位言之有理的主持人,雖然可能因為外力的介入,她離開了電視圈,但她的廣播和podcast,仍然很可喜的活著,繼續傳遞著她理性的聲音。

從她邏輯清楚的分析,對台灣時事和政治,絕對會有更進一步的了解。

Conviction 懸案判決 (2018 movie)

改編法國真實刑事懸案。無屍體,無證據,更無動機,是完美犯罪?還是另有內幕?描述一位單親媽媽諾拉,在調查過程中,掉入案件的錯綜複雜情節,一步步讓自己與小兒子的生活,也步入危險及混亂之中。



無罪推定原則:無罪推定原則(英語:presumption of innocence拉丁語ei incumbit probatio qui dicit),意指一個人若未被證實及判決有罪,在法院上應該先被假定為無罪。在許多國家的刑事訴訟中,無罪推定原則是所有被告都享有的法定權利,也是聯合國國際公約確認和保護的基本人權。在這個原則下,提起公訴的檢察官應負起舉證責任,應負責收集足夠的可靠證據,以證明被告在事實上的確有罪;而若法院要判被告有罪,則所使用的證據必須符合法律限制,而且不能存在合理懷疑。(from: Wiki) 

感想


因為youtuber Will 在「X調查」的影片中推薦了這部片,我才去找來看。果然是擲地有聲的法庭片。



本片改自真實案件,辯護律師用「無罪推定原則」來為被告申冤,片末的十五分鐘結辯才是高潮,因為律師真正火力全開,斥責檢警只是在胡亂栽贓被告,毫無實質證據,他大罵整個控訴只建立在法庭與輿論的猜測與幻想,最終演變為變成是卡夫卡的魔幻小説!(有趣而貼切的比喻😄


因為這位律師可圈可點的表現,使得被告最終獲得無罪判決。坐在螢幕前,我都彷彿可以感受到這位律師因為義憤填膺,所噴出的「狂風暴雨」(口水),法警甚至法官們,都成了他門下的學生,接受著他龍捲風似的教訓。


第一次看法國的法庭片,確實令我驚訝:原來法語也可以這樣鏗鏘有力,在法庭上那樣慷慨激昂!不只是因為音量與肺活量,也在於律師對整個司法和媒體勾結的不滿,對大眾齊心辱罵被告的憤怒,其表現充滿真情與正義!


影片前半段雖然有些單調,編劇所虛構的女主「諾拉」,拼命為被告搜集證據,但也因為諾拉幾乎不顧自己,爲被告名譽與生命的「狂熱」付出,才使得最後的無罪判決格外可貴。


在諾拉無私的奉獻中,讓人體會到什麼叫「愛」:愛不是為了自己的利益,而是為了別人最大的利益而奮鬥。而這個社會,最缺乏的正是這種愛。

不得不動容,我在片尾流下幾滴感動的淚水。網民照例地不懂這部片的好,沒有給予它足夠的正面評價,但是我給予肯定,謝謝製片團隊作出這部有力量的作品!

眾議院和參議院的區別

眾議院(United States House of Representatives)又稱為「下議院」,按各州人口比例決定席次,由各州選民選出的議員組成,人數比參議院來得多,大約 400 多名議員。眾議員任期兩年,無任期限制。眾議院議長則由所有議員投票決定,也因此通常會是多數黨的領導者。

根據美國在台協會官網對美國立法機關的說明,眾議院特有的職權包括:

1. 有權對總統和最高法院大法官提出彈劾。

2. 所有涉及增加税收的提案必須從眾議院產生。

3. 如果總統大選中沒有任何一位候選人贏得多數票,由眾議院議員投票決定總統當選人,一州可投一票。


參議院(United States Senate)又稱「上議院」,參議員為美國每個州各選出兩名代表,美國總共 50 個州,故參議院只有 100 名議員。參議員的任期為六年,無任期限制。由美國副總統兼任參議院議長,對總統任命重要職位和條約擁有獨家建議和同意權。

參議院特有的職權大致包括:

1. 批准總統提名的最高法院大法官、下級聯邦法院法官以及行政機構重要職位的人選。

2. 負責批准或否決總統締結的國際條約。

3. 在發生彈劾總統或最高法院大法官的情況時,由參議院主持審判,全體參議員擔任陪審員。


這也說明了為什麼眾議院在 2019 年、2021 年有權對美國前總統唐納.川普(Donald John Trump)先後發起兩次彈劾案,至於彈劾案後續是否通過,必須交由參議院審理。要留意的是,眾、參議院非固定的上下游關係,而是視議案而定。

Why Johnny Depp lost libel suit in UK but won in US

In Depp’s case in the UK, the burden of proof lay with The Sun, but in the US, it was Depp who had to persuade the jury that Heard not only defamed him, but did so with malice. 

In other words, in the UK, plaintiffs have to show that a false and defamatory statement was made, but in the US they also have to prove an added element of actual malice.

But what really turned the tide in Depp’s favour in the US was the jury as opposed to a single judge in the UK. Experts have highlighted how Depp used a strategy called “deny, attack, and reverse victim and offender” or “Darvo” —  a common defence tactic in sexual assault and domestic violence trials. 

The strategy, experts say, is  “very, very effective against juries” although “lawyers and judges tend not to fall for it” because they are trained to look at evidence.

In this case, Depp’s lawyers employed the tactic effectively, turning him into the victim and Heard the abuser.

The same strategy that was employed in social media as well — the hashtag #justiceforjohnnydepp received 19 billion views on TikTok and trended for weeks on Twitter. It resulted in drawing public attention to the trial — polls reportedly showed that Americans showed more interest in the courtroom drama than the ongoing war in Ukraine or the historic ruling on abortion expected any day from the US Supreme Court. 

Although jurors were instructed not to read about the case online, they were not sequestered or isolated, and were allowed to keep their phones.


Fast Talk; Fast Friends; Fast Asleep

(X)別管他講話太快。
(O)別聽他的花言巧語。

Fast talk表面上看來是「講話很快」,其實是指人講話很快、語言浮誇,不太實在。

經常這樣講話的人,我們可以說他是fast talker。而fast talk更常用來當動詞:

He fast-talked his way into a powerful job.  他靠誇誇其談謀了個要職。


They are fast friends. 

(X)他們很快變成朋友。
(O)他們是很要好的朋友。 

大家熟悉Fast意思是「快」,但它還有一個意思,是「牢固的、安穩的」。來看一例:

He's fast asleep. 

(X)他很快睡著。
(O)他睡得很熟。


Fast asleep 是熟睡,fast不是「很快」,而是「很安穩、很熟」。類似的還有,如果我們說一個規則是hard and fast,意思也是「很明確、很牢固、不能更改」:

We have hard and fast rules for this procedure. 我們對流程規定非常明確。

Fast friend就是取這個意思,「牢固的朋友、可靠的朋友」。再看看例句:

Do you have any fast friend in that company? 你在那家公司有可靠的朋友嗎?



Late, Lately, Recently & Shortly

Late: Late as an adverb means ‘not on time’:

Well, I couldn’t find my classroom, so I got to the classroom a bit late and then I had to sing a song in front of the other students!

Lately: Lately is used for REPEATED events. Something that is recurring often. We use lately for states or for repeated events, mostly with the present perfect:

She says she’s been feeling tired lately. I think she’s working too much. 

 

You asked me if you could interchange 'recently' and 'shortly,' and I said no. Here is why:


Recently (adverb) meaning - at a recent time; not long ago.

- Recently means something just happened. "I recently started studying astro-physics!"

Since the sentence suggests that Jane and Amber have arrived late to the party this one time, we use recently.

Shortly (adverb) meaning - in a short time; soon. 

- Shortly means something is about to happen. "I will start studying astro-physics shortly."
